Craft brewers aren’t normally thought of as hardball competitors.
They’re known for helping new brewers get started and keeping the rivalry friendly. But in some cases, friendship just isn’t possible and the attorneys get involved.
That’s what happened with Mother Earth Brew Co., a craft beer maker in Vista. The company says it has won a trademark ruling against similarly named Mother Earth Brewing Co. LLC, a North Carolina-baser microbrewery, as craft brewers are also known.
The Tarheel State namesake declined to settle the differences amicably, and sought to invalidate Mother Earth Brew Co.’s trademark, said Daniel Love, who co-founded Mother Earth Brew Co. less than two years ago. Owners include Love and his wife along with business partner Kamron Khannakhjavani.
So with help from an investor, the company successfully defended its trademark before the U.S. Patent and Trademark Office, which is headquartered in Alexandria, Va.
The Aug. 22 decision, provided by Love, dismissed the trademark invalidation case “with prejudice,” a legal term meaning the case can’t be refiled. In a letter with the decision, Love’s attorney, Gulnz T. Donahue, recommended his client send a letter requesting that the other company stop using the Mother Earth Brewing trademark and recall all products bearing it.
Mother Earth Brewing Co. did not respond to calls for comment.
In other trademark news the ongoing Highland VS Highlands battle has come to an end: Highlands of Missouri has given in to Highland of North Carolina and has decided to rename themselves Kirkwood Station

Here are some of the better stories to make their way around the North Carolina beer world.
Asheville Scene in WSJ Asheville, a Blue Ridge Mountain town of 75,000, has 10 breweries, with two on the way. That can’t compare with the 40 in Portland, Ore., but it stacks up to other beer havens like Milwaukee and Boulder, Colo., which both have fewer than a dozen. “Asheville is definitely on the map and well recognized in the craft-brewing industry,” says Paul Gatza, director of the Brewers Association in Boulder.
Nantahala Brewing Company
Nantahala brewer Chris Collier explains his story and why North Carolina is a great place for beer in the south:
“Basically, the reason I went to North Carolina is threefold: You can self-distribute, we can have a taproom and sell off-premise, and as you grow your business, you can write your contract anyway you want,” Collier said.
Collier estimates North Carolina has more breweries and brewpubs than the rest of its Southern neighbors combined.
“That is not coincidence,” he said.
Brewers pay expensive excise taxes — about $25 per keg — on their beer, but it is a price that allows them to operate their businesses with relative freedom
CONGRATS TO Jason McCammon The Hendersonville, N.C., resident, who will turn 30 in a couple of weeks, now has something else to celebrate besides the milestone birthday.
His award-winning home-brew — a German-style dark lager called Monkey’s Uncle Munich Dunkel — has been released commercially by Olde Hickory Brewery and is available at a few Asheville-area bars and restaurants.
In late April, McCammon’s beer won a Best of Show gold medal at the Olde Hickory Pro-Am home-brew competition, beating out 130 other entries from the Southeast.
Brewmaster Jamie Bartholomaus said the brewery has purchased a building off Stratford Road to start bottling its beer. The expansion allows production to move from a 7,000-square-foot space to a 48,000 square-foot-space. The current facility can produce two 22 ounce bottles each minute. The new facility, which will be operational within the next six weeks, will boost production to about 100 bottles per minutes, owners said.

Finally after a long brew day, another trip out to fill the barrel and waiting and waiting and waiting, for what seemed like forever, we are almost there! Josh Brewers vision of a Belgian Dubbel fermented with figs and raisins was perfect for Chris Hollifield’s apple brandy barrel. As of now we are looking at final beer somewhere between 8.5 and 9% ABV. The brandy and oak are noticeable on the nose, which should fade a bit and balance out with a little time. The taste is subtle brandy with dark fruit notes and some bread.
As it has aged it has started to dry out on the finish. The next step will be to transfer it out of the barrel and cold age it. From there it will find its way through our doors and into your hands.
The official release will take place at the Raleigh Times Bar on April 6th, 2011 at 7PM in the form of a Beer, Brandy and Brandy Barrel Aged Beer Dinner. If you are interested in tickets please email your request to Katrina@raleightimesbar.com. Space will be quite limited so get your requests in early. A COLLABORATION BORN IN NORTH CAROLINA
Mother Earth Brewing, Carolina Distillery and The Raleigh Times announce plans for a unique brew
When a good friend approached me last fall about a small distillery in Lenoir that was producing apple brandy from North Carolina apples, I immediately thought collaboration! After speaking with Chris Hollifield, a 3rd generation distiller, and Keith Nordan about their brandy it was clear they had something really special. The Carolina Distillery is housed in a 110 year old carriage house in downtown Lenoir, NC. This sounded like a very similar story to Mother Earth Brewery’s renovated warehouse in downtown Kinston, NC. Mother Earth Brewery opened in October 2009, but in that short time Brewmaster Josh Brewer has created some of the best beers in North Carolina. Carolina Distillery’s commitment to local apple farmers, Mother Earth’s commitment to a green brewery and each one revitalizing the sleepy NC towns they call home, made the two a perfect match.
Immediately everyone was on board.
Each batch of Carriage House Apple Brandy is aged in brand new white oak barrels. This means that the barrels can only be used once. So we took one of those barrels, after they had finished aging a batch inside of course and moved it to Mother Earth Brewery where it currently sits awaiting its turn to again be used to create a beautiful concoction that was born in North Carolina.
On Wednesday, January 26th, 2011 a group from Raleigh Times took a trip to Mother Earth Brewery for our very first brew day. As you read this our special brew is busy working, getting ready for fill day when the fun really begins! We will keep you posted over the weeks as we work together to create a true North Carolina treat for the beer and brandy lovers alike. Until then enjoy pictures of brew day!
